1. Acceptance of Terms
By accessing or using the website at blacklandsystems.com or engaging Blackland Systems LLC ("Blackland Systems," "we," "us," or "our") for any services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Services
Blackland Systems provides done-for-you AI automation services for local service businesses, including but not limited to missed lead recovery, appointment reminders, review generation, and customer reactivation campaigns. Specific services, deliverables, and pricing will be outlined in a separate client agreement or proposal agreed upon by both parties.
3. Client Responsibilities
By engaging our services, you agree to:
- Provide accurate and complete business information necessary for us to deliver services
- Ensure that all contact lists, customer data, or phone numbers you provide to us were obtained lawfully and with appropriate consent
- Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA messaging guidelines, and A2P 10DLC requirements
- Not use our services for any unlawful, deceptive, or abusive purpose
- Promptly respond to reasonable requests for information needed to complete your setup or deliver services
4. SMS and Communications Compliance
Client Obligations. Blackland Systems sets up automated SMS and email communication systems on behalf of its business clients. If you are a client, you are solely responsible for ensuring that your customers have opted in to receive automated text messages and emails from your business, that your opt-in and consent records are maintained in accordance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA guidelines, and A2P 10DLC requirements, and that all outbound communications delivered through our systems comply with applicable law. Blackland Systems is not liable for any violations of telecommunications laws arising from your failure to obtain proper consent from your customers or from content you direct us to send.
End-User SMS Program. If you are a website visitor, prospect, or customer of Blackland Systems and you provide your phone number to us, you may receive SMS messages from Blackland Systems related to your inquiry or our services. These messages may include responses to your inquiries, appointment confirmations and reminders, follow-up communications, and service-related notifications.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply. Charges for SMS messages are billed by and payable to your mobile service provider.
- Reply STOP to any message to opt out at any time. After opting out, you will receive one final confirmation message and no further SMS messages from us.
- Reply HELP for assistance, or contact us at [email protected].
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
- Carriers are not liable for delayed or undelivered messages.

5. Payments and Fees
Service fees are outlined in your client agreement. All fees are due as specified in that agreement. Blackland Systems reserves the right to suspend services for non-payment. Fees paid are non-refundable unless otherwise stated in writing.
6. Month-to-Month Engagement
Unless otherwise agreed in writing, services are provided on a month-to-month basis. Either party may terminate services with written notice as specified in the client agreement. Blackland Systems reserves the right to terminate services immediately for violations of these Terms.
7. Intellectual Property
All materials, templates, workflows, automations, and systems created by Blackland Systems remain the intellectual property of Blackland Systems unless otherwise agreed in writing. Clients receive a license to use deliverables for their business during the term of active service.
8. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes your customer data, business processes, and any non-public information shared with us. We will not share your business information with any third party except as required to deliver services or as required by law.
9. Limitation of Liability
Blackland Systems provides services on a best-efforts basis. We do not guarantee specific results, including but not limited to lead conversion rates, review counts, or revenue increases. To the maximum extent permitted by law, Blackland Systems shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services. Our total liability to any client shall not exceed the total fees paid to us in the three months preceding the claim.
10. Disclaimer of Warranties
Our services are provided "as is" without warranty of any kind, express or implied. We do not warrant that our services will be error-free, uninterrupted, or that results will meet your specific expectations.
11. Indemnification
You agree to indemnify and hold harmless Blackland Systems LLC, its owner, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or third-party right.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.
13. Changes to These Terms
We reserve the right to update these Terms of Service at any time. When we do, we will update the effective date at the top of this page. Continued use of our website or services after any changes constitutes acceptance of the updated Terms.
